This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use our services, or make a purchase from augustinusbader.com (the "Site") or otherwise communicate with us regarding the Site (collectively, the "Services"). We hereby inform visitors that this Privacy Policy may be modified at any time. As soon as they are displayed online, each visitor who accesses the Site is deemed to have accepted these modifications without restriction. Please note that this website is operated by Shopify. If you had previously authorised Shopify to store and use your personal information, the Site will automatically retrieve it.

What information do we collect?

  • Identification and contact information (including but not limited to email, mobile number etc.)
  • Demographic information (such as gender or birthday - date and month)
  • Information about your purchases
  • Information about your browser and browser behavior

Account Payment card details entered on the Site are collected directly by Shopify’s payment processor, and are not collected or retained by us. The processor is instructed by us to only use such information for the purposes of processing your transaction with us and otherwise with your consent. Account creation and authentication are handled entirely by Shopify or Shop Pay, which uses the same infrastructure.

Depending on the action you are taking on the Site, we shall collect at different moments the following information:

  • If you place an order, we collect: email, name, billing address, delivery address, telephone, IP address and tokenized payment details.
  • If you sign in to create an account, we will have access to: email address, first and last name, delivery address and billing address.
  • While using your account, we collect: delivery address, billing address, order history and tokenized payment details.
  • If you visit our Site, we store session information through a cookie: address, Device ID, session token and referring website.

Your information will be stored from 2 up to 10 years depending on your local regulation and type of information collected since our last contact (last purchase or last interaction with us), then your information will be archived to be used in the event of a litigation or dispute within the limit of applicable prescription regulation. The Vaan Group

The Vaan Group is our web development agency. It has access to the Site theme and store administration in order to build and support the Site, and may see customer data while doing so.

Warehouse and fulfilment partners

Our orders are packed and shipped by third-party warehouse partners: Capacity (United States), ILG (United Kingdom) and Bergen Logistics (Netherlands). They receive your name, delivery address, contact details and order contents in order to prepare and dispatch your order and process returns.

4. How is your information stored?

We are particularly mindful to ensure appropriate protection and security of our Information Systems. Specific tools allowing us to detect security breaches have been implemented. The implementation of such tools may incidentally entail access by our security services to personal data. This data will be collected and processed for the exclusive purpose of managing the security breach and, in accordance with applicable data protection regulations.

4.1 GDPR Data Protection Notice for Residents of the United Kingdom or the European Economic Areas

This section of our Privacy Policy applies only to you if you are a visitor to our Sites, apps, shop in our online stores or otherwise interact with us as described in this Privacy Policy and are resident in the UK or European Economic Area (“EEA”). If you are resident in the UK or the EEA, we will only process your Personal Data in compliance with applicable data protection laws, including the EU General Data Protection Regulation, the UK General Data Protection Regulation, and related data protection laws in the UK and the EEA (together, the “European Data Protection Laws”). ASC REGENITY LTD is the data controller of your personal data.

The types of Personal Data we process about you are described above in the "Your Personal Information" section of this Privacy Policy. The purposes for which we use your Personal Data are described above in the "How do we use the information collected" section of this Privacy Policy. Our lawful bases for processing your Personal Data that we are collecting , we rely on performance of contract, compliance with our legal obligations and our legitimate interests (i.e., in providing good customer service).

If you fail to provide certain personal data when requested, we may not be able to perform the contract we have entered into with you, or we may be prevented from complying with our legal obligations.

The categories of recipients of your Personal Data are set out above in the "Who do we share the information with" section of this Privacy Policy.

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

We do not carry out automated decision-making or profiling in relation to your Personal Data that would cause a legal or similar effect to you.

4.2 International Transfers

We have implemented standard contractual clauses to ensure adequate safeguards are in place to protect your information where it is transferred to our third-party providers or vendors in territories outside the European Economic Area and Switzerland. Where we share your information with a third-party service provider outside of the European Economic Area and Switzerland (as detailed in the section entitled “How we share the information collected”), we contractually oblige the third-party service provider to implement adequate safeguards to protect your information.

5. Your rights

You may access your personal information and modify or delete it. You may also request a copy of all information we hold about you in a format compatible and structure that allow you to exercise your rights.

You may request that we correct, amend, erase any information that is incomplete, out of date or inaccurate.

You may also refuse, at no cost, to be contacted by us, in which case he/she will no longer receive details on Augustinus Bader products or services.

5.1 US rights

Certain U.S. states have unique requirements regarding the disclosure of data practices, while other states offer extra personal data rights and protections. This California Privacy Notice is effective as of October 23 2025

This notice supplements the information contained in our Privacy Policy and applies only to California residents.

5.2.2 Right to Know

You have the right to request that we disclose information about our collection and use of your Personal Information over the past 12 months, including:

  • Categories of Personal Information we collected;
  • Categories of sources for the Personal Information we collected;
  • Our business purpose for collecting Personal Information;
  • The categories of third parties with whom we share that Personal Information;
  • The categories of Personal Information that we share with those third parties; and
  • The specific Personal Information we collected about you.

In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.

5.2.3 Right to Limit The Use and Disclosure of Sensitive Personal Information

We do not use or disclose sensitive personal information other than to provide you our products or services as permitted by California law. We do not sell or share sensitive personal information for the purpose of cross-context behavioral advertising.

We collect sensitive personal information based on one or more of the following legal grounds:

  • You have given explicit consent to the collection for one or more specified purposes;
  • Where the collection of sensitive personal information is manifestly made public by you; and/or
  • Where the collection is necessary for exercise or defense of legal claims.

5.2.4 Do Not Sell or Share

5.2.4.1 Right to Opt-Out of Sharing

California Consumers have the right to opt-out of the sharing of your Personal Information or Sensitive Personal Information to a third party for cross-context behavioral advertising (i.e., targeted advertising), whether or not for monetary or other valuable consideration.

5.2.4.2 Right to Opt-Out of Sale

California Consumers have the right to opt-out of the sale of your Personal Information or Sensitive Personal Information.

Making Requests to “Opt Out” of the “Sale” or “Sharing” of “Personal Information”

If you are a California Consumer and would like to submit a request to opt out of the sale or sharing of your personal information, you may click on the link “Do Not Sell or Share My Personal Information” on the footer of our Site or you may choose to enable online, where available, a universal tool that automatically communicates your opt-out preferences, such as the Global Privacy Control (“GPC”). We will process the GPC signal as a request to opt out.

5.2.5 Other Important Information for Do Not Sell or Share

We engage in online advertising practices (and certain analytics or similar activities), which may be considered a “sale” or “share” for cross-context behavioral advertising under the CCPA and CPRA.
